Заключение предпринимателей под стражу во время следствия должно быть крайней мерой. Об этом заявил в Государственной думе премьер-министр России Дмитрий Медведев, слова которого приводит ТАСС.

"Нужно продолжить совершенствование законодательства в сфере "предпринимательских" преступлений, я имею ввиду уголовно-процессуальное законодательство, да и уголовное законодательство. Такое поручение было дано президентом в послании Федеральному собранию. Очевидно, что помещать под стражу во время следствия по экономическим преступлениям можно лишь в качестве особой, крайней меры", - сказал он.

По его словам, лишение свободы для бизнеса должно стать крайним и относительно редким наказанием. "Гораздо эффективнее применять по таким составам крупные штрафы, административные санкции, возмещение убытков в гражданском процессе", - заявил премьер-министр.

Для улучшения условий ведения бизнеса будет подготовлена концепция нового Кодекса об административных правонарушениях (КоАП). По словам Медведева, нынешний кодекс стал слишком громоздким, и "предприниматели просто не успевают фиксировать, что же они нарушили в очередной раз". Новый КоАП будет более "компактным" и четким.

В конце марта на сайте правительства было опубликовано распоряжение Медведева представить концепцию нового КоАП до 1 июня 2019 года.

Первый зампред комитета Госдумы по госстроительству и законодательству Михаил Емельянов пояснял, что такая мера назрела из-за большого количества поправок, которые вносятся в кодекс. Сейчас в работе над новым КоАП принимают участие Минюст, Минэкономразвития и другие заинтересованные органы власти и экспертные организации.
