Из-за пробела в законодательстве, который, по требованию Конституционного суда, призваны устранить поправки, подготовленные в МВД, пьяные водители, совершившие ДТП с пострадавшими или погибшими, уезжают с места аварии (за это предусмотрено только административное наказание по статье 12.27 Кодекса об административных правонарушениях), а через несколько дней сами приходят в полицию. При этом установить факт их пребывания в состоянии опьянения в момент ДТП уже невозможно, поэтому им грозят сроки, предусмотренные для трезвых водителей.

Одобренный депутатами законопроект предусматривает, что водители, скрывшиеся с места ДТП, будут по умолчанию нести такую же ответственность, как пьяные. Им будет грозить до четырех лет лишения свободы, если в аварии есть пострадавшие с тяжелыми травмами, до семи лет, если в ДТП погиб один человек, и до девяти лет, если авария привела к гибели двух и более человек. Одновременно был принят во втором чтении законопроект о внесении корреспондирующих изменений в статью 12.27 КоАП – ее новая редакция гласит, что водителю, покинувшему место аварии, в которой никто не погиб и не пострадал, грозит административный арест до 15 суток или лишение прав.

По данным судебного департамента Верховного суда, в первом полугодии 2018 года за совершение ДТП с тяжелоранеными были осуждены 2,7 тыс. человек. За совершение ДТП с одним погибшим приговоры были вынесены в отношении 1,7 тыс. человек, а за совершение ДТП с двумя или более погибшими суды приговорили к наказанию 283 человека.

Напомним, на днях в Госдуму внесли поправки к ст. 264 УК, которые серьезно ужесточают наказания для пьяных водителей, виновных в ДТП с погибшими или пострадавшими. Поправками предусмотрено повышение максимального срока лишения свободы с 4 до 7 лет в случаях, если в результате ДТП пострадавшим был нанесен тяжкий вред здоровью. За аварию с одним погибшим предлагается наказывать заключением на срок от 5 до 12 лет (сейчас за совершение такого ДТП грозит от 2 до 5 лет), а с двумя и более погибшими – на срок от 8 до 15 лет (сейчас 4-9).
